VISA SPECIALTY OCCUPATIONS
(CONSULAR PROCESSING)
Overview
The H-1B1 program provides for the temporary employment of nonimmigrant workers in
specialty occupations from Chile and Singapore, limited to 1,400 nationals of Chile and 5,400
nationals of Singapore. The H-1B1 program is governed by many of the rules that apply to the H-1B program.
The period of employment is 1-3 years and further extensions can be obtained indefinitely.
U.S. Company Requirements
- Be an existing company in the U.S.
- Have the ability to pay the salary to the H-1B1 employee based on the prevailing wage rate o The prevailing wage rate is defined as the average wage paid to similarly employed workers in a specific occupation in the area (geographical location) of intended employment
Applicant’s Requirements
- Chilean or Singaporean nationality
- Academic Degree or Equivalent (Work experience) in a specialized occupation
- Employment offer which is contingent upon approval of the visa application Some of the Advantages of the H-1B1 Visa are
- No cost to the employer
- Visa processing times is approximately 5-6 weeks or less (Consular)
- It can be renewed indefinitely
- It can be changed to H-1B to start a permanent green card process
- The H-1B1 limit has never been exhausted; therefore there has never been a lottery
- It can be requested any day of the year
- The employee can start work as soon as he/she receives the work documents
- Employers are exempt from the Anti-fraud fee ($500) and the American Competitiveness and Workforce Improvement Act (ACWIA) Training Fee ($750/$1,500)(Consular)
- Someone on an F-1 student visa can change to an H-1B1 inside the US without having to return to a country abroad
- High approval rate (2020: 97.9% & 2019: 96.4%) Most employers are not familiar with this visa because they think it is the same as the H-1B visa, but it is not. The H-1B1 visa has more advantages for employers and employees than the H-1B visa
